“Not all sexually oriented communications seduce or lure, as recognized by the Florida Senate Criminal Justice Committee”
First, I want to reiterate that I did not engage in any illegal activities, and if you read the chat transcript in the deposition below, you will see that no vulgar language was used, no body components were mentioned, and I never used the word 'we'. While parts of the conversation may be construed as sexually themed or even inappropriate, I tried to end the conversation twice, but as the judge stated “she was persistent.” Even then I did not engage in any acts of seduction, soliciting, luring, or enticement of the individual posing as a child.
Furthermore, while the purpose of the website may make me a bad husband to previous unfaithful wife, it does not rise to the level of being accused as a child predator. I may have made a mistake by engaging in conversation on the website, but I never had any intention of harming or exploiting a child. In fact, my intention was to determine if a child was in danger and to report it to the authorities.
It is frustrating and devastating to be falsely accused and convicted of a crime I did not commit, particularly when I was trying to do the right thing. Additionally, I believe that law enforcement is crossing unethical boundaries by not positively following up on suspected child predators but is merely casting a net to see who bites. It is clear from the deposition transcript that the individual posing as a child was not solicited or encouraged to engage in any sexual activity, but rather willful and made false assumptions based on blanket, vague statements made by me after she wantingly solicited such responses.
Some may wonder, 'Why not end the conversation?' My response would be, 'If this was your daughter, wouldn't you want someone to report it?' I'm sorry, leaving a potential child in danger, known or not sure, without proof otherwise, is not in my nature.
I want to make it clear that I take full responsibility for my actions and understand that engaging in conversation, with a pretend minor, on a website designed for adults was not a wise decision. However, I did not engage in any illegal or predatory behavior towards children, and I believe that the deposition below supports my claim that I never solicited anything. I did not testify because I want the people of this country to see how far agents go to obtain an arrest and conviction.
Based on the sexual nature of the responses, and these photos, received from "SaraSara14," I had reason to doubt that this user was a child. The content of the messages was inappropriate and suggestive, which led me to suspect that the user may have been an adult posing as a child. However, regardless of the user's actual age or identity, the inappropriate and unhelpful nature of the responses was concerning and necessitated further action
During ICAC's "Operation Cupid's Arrow" sting in Florida (Feb 8-12, 2017), I stumbled upon a missing teen alert for Q.M. issued by the Tallahassee Police Department. My attempt to assist led me to uncover PDF pages 1 and 2, revealing TPD’s focus on Tallahassee and Orlando.
On February 11th, I had a questionable experience while using the website "SeekingArrangements." I came across a profile of a faceless girl that matched some of the details provided in a missing person alert. The profile was active in both Tallahassee and Orlando, leading me to believe that it could be a potential match for Q.M.
